Terms of Use

1. About these terms

NetPosition is operated by Prime Management and Advisory Pty Ltd (ABN 85 676 319 896) of 5 McIlwraith Avenue, Norman Park QLD 4170 (“we”, “us”, “our”). By creating an account or using the service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

2. General information, not advice

Everything in NetPosition is factual information and educational modelling based on the figures and assumptions you enter. It does not take into account your full objectives, needs or circumstances.

• We do not hold an Australian financial services licence or an Australian credit licence, and we are not a registered tax agent or BAS agent.
• Nothing here is a recommendation to buy, sell or hold any property, investment or financial product, or to take out or change any loan.
• Borrowing figures are illustrative. They are not a lender’s assessment, a pre-approval, or an offer of credit, and a lender will apply its own rules.
• Before you act, get advice from a licensed financial adviser, mortgage broker, accountant or registered tax agent who knows your situation.

You are responsible for your own decisions and for checking that the figures you enter are accurate and complete.

3. Tax estimates

Tax figures use published Australian resident rates and thresholds for the year shown, and an optional Medicare levy. They are estimates. Your actual tax depends on your full circumstances and on the ATO’s assessment. Tax rules change, and we may not update the service the moment they do, so always check the ATO or a registered tax agent.

4. Forecasts, assumptions and risk

• Projections, roadmaps, stress tests and “what if” comparisons rest on assumptions such as growth, interest rates, inflation, rent, costs and how much you save. Real outcomes will differ, and may be much worse.
• Forecasts assume no major economic shocks, and no changes to tax, super, lending or property law. Future changes, for example to negative gearing, capital gains tax or super tax, could reduce your results.
• Past performance is not a reliable guide to future returns. All investing, including property and shares, carries the risk of loss.
• Property is generally illiquid and costly to buy and sell. Vacancies, repairs, rate rises and falling values can happen, and are hard to model.

Do not rely on a single projection to make a major financial decision.

5. Your account

• You must be 18 or over.
• Give us accurate information and keep it up to date.
• Keep your sign-in details safe. You are responsible for activity under your account, and you must tell us promptly at admin@netposition.com.au if you suspect unauthorised use.
• An account is for one person or one household (you and your partner). Do not share it more widely or resell access.
• If you enter information about another person, such as a partner, you confirm you are entitled to do so.

6. Your data

You own the figures and details you enter. You give us permission to store and process them only so we can provide, secure and improve the service, as described in the Privacy Policy. You can delete your account at any time from Account settings. Deletion is permanent and cannot be undone, although some billing, security or legally required records may be kept for the periods set out in the Privacy Policy.

7. Plans, trials and billing

• Plans and prices are shown on the Subscribe page and again at checkout. Prices are in Australian dollars and include GST.
• Trials: new accounts may receive a free trial of paid features, and buying a plan may include extra trial time, as described on the Subscribe page at the time. You do not need a payment method to use a free trial. A trial ends automatically, and your account then moves to the Free plan unless you subscribe.
• Payments are processed by Stripe. Subscriptions renew automatically each month or year until you cancel, and we charge the price shown at purchase.
• Cancelling: you can cancel at any time from Account settings, which opens the Stripe billing portal. Your paid access continues to the end of the period you have already paid for, then your account moves to the Free plan.
• Refunds: fees already paid are not refundable, except where the law requires a refund.
• Price changes: we will give you at least 30 days’ notice before a price change affects your subscription, and you can cancel before it takes effect.
• Failed payments: if a payment fails we may retry it, and we may pause paid features until it is resolved.
• Deleting your account cancels any active subscription straight away, with no refund of the current period unless the law requires one.
• Do not abuse trials, for example by creating multiple accounts to get repeat trials.

Nothing in this section limits your rights under the Australian Consumer Law.

8. Acceptable use

You must not:

• use the service unlawfully or to harm others;
• try to access another person’s account or data, or probe, disrupt or overload our systems;
• scrape, copy or reverse engineer the service, or use it to build a competing product;
• upload malicious code or content you have no right to share.

9. Third-party services and data

Parts of the service depend on third parties, including Stripe (payments), Supabase and Vercel (hosting and storage) and Google (maps, only when you ask). We are not responsible for third-party services, their availability, or their terms. Rates, thresholds and other reference data come from public sources. We take reasonable care with them but do not warrant that they are complete, current or error free.

10. Intellectual property

We own or license the NetPosition software, design, calculations and content, other than what you enter. You may use them for your own personal planning while you have an account. You may not copy, republish, sell or build on them without our written consent.

11. Availability, changes and ending the service

We aim to keep the service running but do not promise it will be uninterrupted or error free. We may change, add or remove features, and we may discontinue the service. If we discontinue it, we will give you reasonable notice where we can and refund any prepaid period we cannot deliver. We may suspend or close an account that breaches these terms or puts the service or other users at risk, and we will give you notice where it is reasonable to do so.

12. Disclaimers and liability

Our service is provided as a general information tool. To the extent the law allows, we do not promise that the estimates, projections or reference data are accurate, complete or suitable for your purposes.

Our service comes with guarantees that cannot be excluded under the Australian Consumer Law. Subject to those, and to the extent the law allows, we are not liable for any indirect or consequential loss, loss of profit, or loss arising from decisions you make using the service, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Where a consumer guarantee applies, our liability for breach of it is limited, where the law permits, to resupplying the service or paying the cost of having it resupplied.

13. Changes to these terms

We may update these terms. We will post the new version here with a new “last updated” date, and we will email you or tell you in the app about material changes before they take effect. If you keep using the service after the change takes effect, you accept the updated terms. If you do not accept them, you can delete your account.

14. Governing law

These terms are governed by the law of Queensland, Australia, and each party submits to the non-exclusive jurisdiction of the courts of Queensland.
